1. Acceptance of Terms

By accessing or using MagicKidStory.online ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

MagicKidStory.online provides an AI-powered platform that generates personalized bedtime stories for children. The Service allows parents and guardians to create custom stories based on their child's name, age, interests, and preferences.

3. Account Registration

To use certain features of the Service, you must register for an account. You agree to:

Provide accurate, current, and complete information
Maintain and update your account information
Maintain the security of your account credentials
Accept responsibility for all activities under your account
Be at least 18 years old or have parental consent

4. Subscription Plans and Billing

4.1 Subscription Tiers

We offer Free and Premium subscription plans. Free plans have limited features and usage. Premium plans provide unlimited access to story generation and additional features.

4.2 Billing

Premium subscriptions are billed monthly or annually. Payment is processed through Creem, our payment provider. By subscribing, you authorize us to charge your payment method for the subscription fee.

4.3 Automatic Renewal

Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. You will be charged the then-current subscription fee.

4.4 Price Changes

We reserve the right to modify subscription prices. Existing subscribers will be notified of price changes at least 30 days in advance. Continued use after the change constitutes acceptance.

5. Refund Policy

We offer refunds under the following conditions:

Free Trial Period: If you cancel within 7 days of your first paid subscription, you may request a full refund.
Service Issues: If the Service is unavailable or not functioning as described for an extended period, we may provide a prorated refund.
Billing Errors: If you are charged incorrectly, we will refund the erroneous charge.

Refund requests must be submitted within 30 days of the charge. Refunds are processed to the original payment method within 5-10 business days. To request a refund, contact us at the email address provided below.

6. Cancellation

You may cancel your subscription at any time through your account settings or by contacting us. Cancellation takes effect at the end of your current billing period. You will retain access to Premium features until the period ends. No refunds are provided for partial billing periods.

7. Acceptable Use

You agree not to:

Use the Service for any illegal purpose
Generate content that is harmful, offensive, or inappropriate for children
Attempt to reverse engineer or extract our AI models
Use automated systems to access the Service without permission
Share your account credentials with others
Resell or redistribute content generated by the Service
Interfere with or disrupt the Service

8. Content Ownership

Stories generated through the Service are created for your personal, non-commercial use. You retain rights to the personalized content, but you may not resell, redistribute, or use the content for commercial purposes without our written permission. We retain rights to our AI technology, platform, and underlying systems.

9. Intellectual Property

The Service, including its original content, features, and functionality, is owned by MagicKidStory.online and protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, or create derivative works of the Service.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

12. Indemnification

You agree to indemnify and hold harmless MagicKidStory.online, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service or violation of these Terms.

13. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Service will cease immediately.
